Navigating Workplace Challenges with Experience and Integrity

Workplace Investigations
&
Employment Law Consulting

Leveraging over 20 years of employment law experience, Emily Flynn Law helps clients make informed decisions by:

  • Conducting prompt, thorough and objective investigations to prevent and resolve sensitive workplace matters

  • Providing specialized employment law consulting and advisory services on an as-needed basis

Services

Independent Investigations

Claims of workplace misconduct and impropriety expose an organization to potential liability, cultural damage, and reputational harm. Retaining an independent investigator for fact-finding offers many benefits:  avoiding claims of bias or appearance of bias; the ability to rely on resources who have dedicated time and a unique skill set; and increased employee willingness to speak freely when providing key information.

In my role as independent investigator, I conduct prompt, unbiased and thorough workplace investigations in areas including:

  • Discrimination

  • Retaliation

  • Sexual Harassment and other forms of workplace harassment

  • Whistleblower claims

  • Violation of Company Policies, including Ethics and Code of Conduct Violations

  • Wage and Hour

  • Workplace Misconduct

  • Workplace Performance Issues

Employment Law Consulting

For clients who are not retaining me for independent investigations, I provide employment law consulting in specialized areas including:

  • Overseeing internal investigations

  • Guidance around complex or sensitive employee relations matters

  • Assistance with threatened legal claims and dispute resolution

  • Advisory services for complicated leaves, ADA accommodations, worker misclassification, and wage and hour issues

  • Risk mitigation advice around wrongful discharge claims

  • Assistance with legal issues surrounding hirings and terminations

About Me

Based in the Bay Area, I have been practicing employment law for nearly twenty-five years. I graduated Phi Beta Kappa from University of California at Davis with a BA in History with Honors and received my Juris Doctorate with Honors from University of Minnesota Law School.

I began my legal career working as an employment litigator at top-rated law firms including Pillsbury Winthrop, Paul Hastings, and a highly-regard employment boutique firm.  I then served as in-house employment counsel in several industries, along with my own consulting practice serving as outside inhouse employment counsel to companies of all sizes. I now harness that experience to conduct independent workplace investigations, along with providing specialized employment law consulting services. When I am not working, I spend time with my husband and teenage twins, traveling (or thinking about traveling), riding my Peloton, eating good food, and trying to stay on top of what is happening in the world.
